NOVEMBERS DOOM: ACCUSE WLUP (THE LOOP, CHICAGO) OF ALTERING BANDS ART WORK (PALE HAUNT DEPARTURE) FOR RADIO STATIONS LOGO

Chicago, Illinois based death/doomsters NOVEMBERS DOOM have accused  CHICAGO, ILLINOIS radio station, WLUP  (THE LOOP ) of altering the bands art work for PALE HAUNT DEPARTURE for the radio station logo.

This was the image sent to WLUP showing the original artwork and their artwork.
NOVEMBER'S DOOM  unleashed "Aphotic", 5/15/2011 via THE END RECORDS.

FROM NOVEMBERS DOOM:

Chicago radio station WLUP (The Loop) used the Novembers Doom cover art from The Pale Haunt Departure (only altered to add their logo into the image) to promote their radio station, without permission. When they were confronted about it, their response was "It was an honest mistake." So my question to you is this...

Is stealing copy written artwork and altering it to use as your own without permission or compensation and then getting caught the same thing as an honest mistake, or is it a lazy digital media department?
