FISHBONE were ordered to pay $250, 000 in punitive damages after a million dollars in a lawsuit after a (non fan) KIMBERLY MYERS was injured after vocalist ANGELO MOORE's stage dived at WXPN's WORLD CAFE in 2010.
Allegedly, MYERS lost consciousness and suffered shoulder pain, memory problems an auto immune disorders since the mosh pit accident.
FISHBONE unleashed "Crazy Glue" (EP) in 2011 and "Still Stuck in Your Throat" 10/16/20016 via TER A TERRE.
FROM FISHBONE:
A Message To Kimberley Myers:
On February 23, 2010, Kimberley Myers attended a Fishbone performance at the World Cafe Live in Philadelphia. She was not familiar with Fishbone or our performance style. The World Cafe Live venue is a singer songwriter venue and there was no mosh pit. According to the World Cafe Live, no one had ever stage dived at the venue before. Fishbone was an opening act and Ms. Myers had come to see the English Beat. Ms. Myers had no basis to believe that there would be any stage diving.
Ms. Myers has told us that when Angelo Moore dove from the stage as
part of his performance, she was struck by him and suffered injuries. We
did not become aware of these injuries until long after the concert. No
one at the performance told us that anyone was injured. We did not
intend that anyone be injured and are very sorry that Ms. Myers was
injured. If we had been aware of the injury we would have stopped the
show and made sure she received medical attention. We don’t dispute she
suffered serious and permanent injuries as a result of this incident
through no fault of her own.
Angelo is very sorry that his actions caused Ms. Myers injury. In the past we have blamed Ms. Myers for her own injuries and called her complaints against us “false and unfair.” We regret making these statements and withdraw them.
We sincerely apologize to Ms. Myers and we ask our fans to treat her with the dignity and respect she deserves.
- Angelo Moore and John Norwood Fisher
