ITP V.013 SOCIAL JUSTICE: DOMA AND PROP 8 OVER TURNED

                                                                                                             The U.S. Supreme Court via a 5-4 ruling has over turned and rejected DOMA and PROP 8 as gay marriages are now LEGAL in California and so ruled discrimination against gays is deemed unconstitutional.

For 83-year-old Edith Windsor, a New York widow whose case is before the court, such a ruling would give her a refund of $363,000 in estate taxes that were paid after the death of her spouse, Thea Spyer.

Today marks a watershed moment in history and a tremendous victory for the principle of equality. The 5-4 decision by our Supreme Court striking down DOMA affirms the universality of love--the desire of all people not only to find, but to value and affirm, a lifelong commitment to another person. 

I have lived nearly four score years, and have borne witness to both the heartbreak and promise of true justice and equality in America. Today my heart soars, and my faith in the promise of our great nation is renewed. 

Now, if there's anything we gays know how to do well, it is to celebrate! Let the joy of this day ring out with PRIDE.

History was made today as the U.S. Supreme Court returned marriage equality to California.
The Court also invalidated the discriminatory Defense of Marriage Act (DOMA) – sofinally couples in the growing number of marriage equality states will also get the federal rights and benefits they deserve.
And though today will be remembered as a watershed moment in the fight for equality, the Court unfortunately stopped short of a broader decision on the fundamental right to marry.
Millions of us have been fighting for years – first to stop Prop. 8 from passing, and then to reverse it. Today's victory, while joyous, is a reminder of the long road to win marriage equality nationwide.


Those of us who have been working on these cases would not have reached this moment without the courageous plaintiffs, the brilliant legal teams (including Ted Olson, David Boies, Roberta Kaplan, American Foundation for Equal Rights (AFER), the ACLU, and the law firms involved), and all of you.
The coming day will be filled with celebration. But with millions still living without equal rights, we will not stop until every LGBT person – wherever they live – has full equality under the law, including the right to marry the one they love.

"DOMA seeks to injure the very class New York seeks to protect. By doing so it violates basic due process and equal protection principles…"

With these words, the Supreme Court in a 5-4 decision struck down a portion of the Defense of Marriage Act. It also found that the petitioners in the Proposition 8 case had no legal standing to bring suit, allowing the lower court’s decision to stand. Marriage equality will return to California.

The Hudson Valley LGBTQ Community Center is pleased because these decisions represent a small yet significant step toward the full recognition of lesbian, gay, bisexual, transgender, queer and questioning people as citizens in the United States. As taxpaying, upstanding members of this democracy, LGBTQ people deserve the equal protection, rights and liberties afforded to other US citizens.
